Privacy Policy Relating to Use of Personal Data

In the case of Member Customers and Non Member Customers (each as defined below) this Privacy Policy forms part of the Terms and Conditions of Sale and the Terms and Conditions of Use (both as defined below). In the case of Member Users and Non Member Users (each as defined below), this Privacy Policy forms part of the Terms and Conditions of Use and is a statement as to how 24 Seven Communications Ltd (as defined below) will process your (as defined below) Personal Data (as defined below).

By accepting the provisions of this Privacy Policy you (as defined below) are consenting to 24 Seven Communications Ltd processing (as defined below) of your Personal Data in accordance with the provisions of this Privacy Policy.

  1. Definitions
    1. In this Privacy Policy, the following words and expressions shall have the following meanings unless the context otherwise requires:

      "24 Seven Communications Ltd"
      A trading division of a company registered in England and Wales with registration number 04468566 whose registered office is at Novis and Co, Chartered Accountants, 1 Victoria Court, Bank Square, Morley, Leeds, West Yorkshire, LS27 9SE (24 Seven).
      "Compliance Officer"
      The person referred to in Paragraph 3.4 ("Your Rights") below appointed by us to deal with issues regarding our compliance with the DPA and the Privacy Regulations;
      "Customer Services"
      The persons employed by us (or by our Data Processors on our behalf) or contracted to us to provide Customers and Users with help and assistance in respect of their dealings with, inter alia, us;
      "DPA"
      The Data Protection Act 1998;
      "Generic Data"
      Anonymous information which does not specifically identify you;
      "Member"
      A person who has completed the online registration form on the Site to open an account with us and has been subsequently accepted by us as an account holder and "Members" and "Membership" shall be construed accordingly;
      "Member Customer"
      A Customer who is registered by us as a Member;
      "Member User"
      A User who is registered by us as a Member;
      "Non Member Customer"
      A Customer who is not a Member Customer;
      "Non Member User"
      A User who is not a Member User;
      "Privacy Regulations"
      The Privacy and Electronic Communications (EC Directive) Regulations 2003;
      "Site"
      24seven.co.uk, being the web site address operated by us;
      "Terms and Conditions of Sale"

      "Terms and Conditions of Use"

      "User"
      A person who, for the purposes of a particular visit to the Site where he is not a Customer, uses the Website;

      A Member Customer, a Non Member Customer, a Member User or a Non Member User as the case may be.
    2. In this Privacy Policy the following words and expressions shall have the same meanings attributed to them as in the DPA unless the context otherwise requires:

    3. In this Privacy Policy the following words and expressions shall have the same meanings attributed to them as in the Terms and Conditions of Sale unless the context otherwise requires:

      "Contract"
      However in this Privacy Policy such definition will be extended to include a Contract which has been subsequently terminated in accordance with the Terms and Conditions of Sale or the Terms and Conditions of Use.
      "Customer"
      However in this Privacy Policy such definition will extend to include former Customers.
      "E-mail Confirmation"
      "Goods"

  2. Introduction

    We are the Data Controller in respect of Personal Data relating to you that we Process from time to time. We take the security and privacy of you and your Personal Data seriously and we are committed to safeguarding your privacy on line. Our primary reason for collecting your Personal Data is to enable us to fulfil our obligations to Customers in respect of Contracts and to make the service we provide for you more efficient. We do not anticipate collecting or processing Sensitive Personal Data about you.

    This Privacy Policy may change from time to time. Any changes we may make to our privacy policy in the future will be posted on this page and, where appropriate, notified to you by e-mail so please check it periodically.

  3. Our Policy For Processing Your Personal Data And/Or Sensitive Personal Data
    1. What Personal Data Do We Process About You And Where Do We Get It From?

      When you enter into a Contract on-line as a Customer, register with us as a Member or simply contact us through the "Contact Us" link on the Site or by telephone by E-mail or by post through our Customer Services service (whether as a Customer or as a User) we will collect Personal Data from you (including in particular information such as your name, address, previous address, other contact details including your E-mail address and mobile telephone number, your date of birth, employment details, income details, credit or debit card details, credit reference details and security information (for example user names and passwords) amongst others).

      Notwithstanding the above your personal information may be obtained by us (or by a Data Processor on our behalf) in any of the following ways:-

      1. On-line forms from time to time;
      2. Through the "Contact Us" link on the Site;
      3. Notwithstanding (ii) above, through E-mail communications with you from time to time;
      4. By dealing with one of our employees (or an employee of one of our Data Processors) over the telephone, by E-mail or by post;
      5. By telephone recording by us (or by a Data Processor on our behalf);
      6. Automatically by your internet browser by using a cookie file which is stored on your browser or the hard drive of your computer. Cookies contain information that is transferred to your computer's hard drive. They help us to improve our Website and to deliver a better and more personalised service. Some of the cookies we use are essential for the Website to operate;
      7. From other sources: we might receive information about you from other sources. If so, we may add such information (or part of it) to the information we hold about you; and/or
      8. By you replying to mailings and other promotions from time to time.
    2. What Do We Do With Your Personal Data?

      We will process your Personal Data so that:

      1. We (or a Data Processor on our behalf) can process your order for Goods in terms of a proposed Contract with a view to entering into the proposed Contract in question subject to the Terms and Conditions of Sale and the Terms and Conditions of Use;
      2. We (or a Data Processor on our behalf) can fulfil our obligations to you under any Contract subject to the Terms and Conditions of Sale and the Terms and Conditions of Use;
      3. We (or a Data Processor on our behalf) can provide your details to the supplier of the Goods to organise delivery of Goods to you in pursuance of a Contract;
      4. We (or a Data Processor on our behalf) can learn about you to enable us to personalise and continually improve your shopping experience at the Site;
      5. We (or a Data Processor on our behalf) can improve our online store and platform and to prevent or detect fraud or abuses of the Site.
      6. We (or a Data Processor on our behalf) can assist you through the "Contact Us" link on the Site or through the Customer Services service by telephone, by E-mail or by post in relation to any specific queries you may have from time to time in relation to us, a Contract or a proposed Contract, the Goods in question and/or the Site;
      7. We (or a Data Processor on our behalf) can deal with general queries you raise from time to time through the "Contact Us" link on the Site or through the Customer Services service by telephone, by E-mail or by post;
      8. We can send you information (by post, email, by telephone) about (1) our products and services and provisions, (2) products, services and promotions of any companies which are part of the group of companies which we may be a part from time to time, and/or (3) products, services and provisions of other carefully selected companies, in each case that we think may be of interest to you. This is often referred to as "direct marketing" and "host mailing" respectively. If at any time you do not want to receive such information then please contact our Compliance Officer in accordance with Paragraph 3.4 ("Your Rights") below or, if you are a Member, update your account preferences;
      9. We can gather Generic Data about what pages you visit on the Site, how long you stayed on each page, and the route you took to navigate through the pages to help us monitor the accessibility of the Site and what your needs might be so that we can develop and improve the Site generally, in direct response to your requirements; and/or
      10. If you are a Member, we can operate, update and maintain the Membership area of the Site to enable us to personalise and continually improve your Membership and the benefits it brings to you.
      11. Other purposes for which we will process your Personal Data are:

      12. The general administration of your account in respect of a Contract or Contracts by us or by a Data Processor on our behalf;
      13. The general maintenance of our data base and other information databank by us or by a Data Processor on our behalf;
      14. For security purposes to protect your Personal Data and Sensitive Personal Data (if any) held and/or processed by us or by a Data Processor on our behalf in accordance with the DPA;
      15. For training our employees or those of our Data Processors in respect of providing our service to you; and/ or
      16. For credit referencing in so far as your Personal Data and Sensitive Personal Data (if any) relating to a Contract or a proposed Contact will be processed by us or by a Data Processor on our behalf for credit referencing purposes.

      All or some of the above purposes could or will apply to you as a Member Customer, all (with the exception of (viii) and (x) above) or some of the above purposes could or will apply to you as a Non Member Customer, all (with the exception of (ii), (iii), and (xi) above) of the above purposes could or will apply to you as a Member User and all (with the exception of (ii), (iii), (viii), (x) and (xi) above) or some of the above purposes could or will apply to you as a Non Member User as the case maybe.

      Having regard to your specific instructions from time to time, purposes (viii) above will apply to you as a Member Customer or as a Member User (as the case maybe) unless and until we receive notification from you to the contrary as referred to in (viii) above. It will not apply to you as a Non Member Customer or as a Non Member User.

      We (or Data Processors on our behalf) may from time to time use 'cookies' to store and sometimes track information about you and to personalise/ customise the service which we provide to you through the Site. Your continued use of this Site is conditional on your willingness to accept our cookies. Your continued use of this Site constitutes an agreement on your part to accept our cookies. A cookie is a small amount of data transferred from our server, which is then stored on your computer's hard disc drive. You can set your internet browser to refuse cookies. Alternatively you can ask your internet browser to alert you when a cookie is being set up. Some of the services on the Site are only activated if a cookie is stored on your hard disc drive therefore, if you choose not to accept the relevant cookie the particular service on the Site in question may not work as we intend it to work. This issue of cookies is relevant to you whether you are a Customer or a User.

    3. Who Else Gets To See Your Personal Data?

      In light of the different purposes highlighted in Paragraph 3.2 ("What do we do with your Personal Data") above we will from time to time need to disclose your Personal Data to various third parties. These third parties are:

      1. Our Data Processors (which may include without limitation: the persons who host the Site on our behalf; the persons who maintain, update and administer the Site on our behalf; the persons who maintain, update and administer the Membership on our behalf, the persons who carry out the Customer Services on our behalf; the persons who provide credit/debit card payment facilities (whether online or by telephone) on our behalf; the persons who help us fulfil Contracts for example: delivery, packaging, sending postal mail and E-mail and so on, the persons, unless you have notified us to the contrary, who carry out "direct marketing" and/or "host mailing" on our behalf; and/or the persons who carry out any training on our behalf);
      2. Our suppliers;
      3. Other companies which are part of the group of companies which we may be a part from time to time;
      4. Unless you have notified us to the contrary, other carefully selected companies who provide goods and services which we think may be of interest to you; and/or
      5. Manufacturers of the Goods;
      6. Our authorised employees and/or authorised employees of our Data Processors; and/or
      7. (in circumstances where you request our assistance to upload your Personal Data) our affiliated finance partners.

      All or some of the third parties set out above to whom your Personal Data could be disclosed could or will apply to you as a Member Customer; all (with the exception of (i) insofar as it relates to "direct marketing" or "host mailing" and (iv) above) or some of such third parties could or will apply to you as a Non Member Customer; all (with the exception of (ii) and (v) above) or some of such third parties could or will apply to you as a Member User; and all (with the exception of (i) insofar as it relates to "direct marketing" or "host mailing" (ii), (iv) and (v) above) or some of such third parties will apply to you as a Non Member User as the case maybe.

      The third parties identified at (i) insofar as it relates to "direct marketing" or "host mailing" and (iv) above will apply to you as a Member Customer] or a Member User (as the case may be) unless and until we receive notification from you to the contrary as referred to in Paragraph 3.2 (viii) above. They will not apply to you as a Non Member Customer or a Non Member User.

      If you are based in a country outside the European Economic Area then your Personal Data could be transmitted/transferred outside of the European Economic Area either by you to us (or a Data Processor on our behalf) or by us to you. By accepting the provisions of this Privacy Policy you are consenting to such transfer/ transmission outside of the European Economic Area and you acknowledge that the county in question may not have data protection laws to the level of the DPA and/or the Privacy Regulations.

      By accepting the provisions of this Privacy Policy you are consenting to the disclosure of your Personal Data by us as set out in this Paragraph 3.3

      Otherwise we will not disclose your Personal Data to other third parties unless we have your permission to do so or where we are required by law to disclose such information.

    4. Your Rights

      You have the right to object to your Personal Data being used for 'direct marketing' and/or "host mailing" purposes.

      If you do not want to receive such "direct marketing" and/or "host mailing" please contact our Compliance Officer, (or such other person as we determine from time to time) in writing as follows:

      As mentioned in more detail in Paragraph 3.2 above, you can set your internet browser to refuse cookies or you can ask your internet browser to alert you when a cookie is being set up.

      You have the right under the DPA to request from us information as to what Personal Data we (or our Data Processors in so far as they are processing your Personal Data on our behalf) are processing about you. Such requests should be made in writing to our Compliance Officer (see contact details above) and should be accompanied by a £10 fee. We will provide you with the relevant information within [40 days] of receipt of the said fee.

      You have other rights under the DPA in relation to our processing of your Personal Data and other rights under the Privacy Regulations.

      It should be noted that we give you access to a broad range of information about you (if you are a Member Customer or a Member User), your account with us (if you are a Customer), your interactions with the Site for the purpose of viewing and in certain cases, updating that information.

    5. Maintenance Of Your Personal Data

      We are committed to the security of your Personal Data

      As a Member Customer or a Member User (as the case maybe) you will be required to have login details which will be unique to you. These comprise an "email address" and a "password". It is your responsibility to ensure that such login details are not disclosed to any third party.

      If you are a Member Customer or a Member User (as the case maybe) then your online account with us has secure access. You will be required to provide your Customer login details to access your account with us online.

      We do not provide any on-line security when you actually provide us with your Personal Data. It is your responsibility to ensure that such information is not disclosed to third parties as you enter it into via any online application form or the "Contact Us" link on the Site whichever the case may be.

      We do not provide any on-line security as your Personal Data is transmitted to us (or our Data Processor on our behalf) via the internet. This also applies to information provided to us (or our Data Processor on our behalf) through the "Contact Us" link on the Site.

      Once your Personal Data is stored in our data base or otherwise in electronic form by us (or our Data Processor on our behalf) it is password-protected and is only accessible by our employees (or those of our Data Processor on our behalf) authorised to access such information. This also applies to information provided through the "Contact Us" link on the Site.

      All of your Personal Data, which is stored our data base or otherwise in electronic form by us (or our Data Processor on our behalf) on a server, is kept in a locked data centre accessible only by swipe card (namely by our authorised employees (or those authorised employees of our Data Processor on our behalf) and monitored at all times by CCTV.

      See the information at Paragraph 3.4 ("Your Rights") above in relation to your ability (if you are a Member Customer or a Member User) in certain circumstances to electronically update the information we hold about you on-line.

    6. General Application Of Our Privacy Policy

      It should be noted that this Privacy Policy only applies to the collection and use of your Personal Data provided to us (directly or via our Data Processors on our behalf) and not to Personal Data you may provide directly to other persons (including without limitation our suppliers, any of the manufacturers of the Goods or products advertised on the Site, and third party advertisers to which links may be situate on the Site). Each of these persons (including our Data Processors will have their own policies in respect of processing Personal Data you provide to them directly and/or to your Personal Data that we may disclose to them in accordance with this Privacy Policy.
